Vous le savez : Yo du Milieu, slameur-comédien, risque une amende de 400 euros pour outrage au drapeau tricolore. Son crime ? S’être vêtu d’une burqa bleu-blanc-rouge lors d’un spectacle de rue. Le procureur lui a longuement expliqué la chose lors de son procès, le 30 septembre dernier, allant même jusqu’à remettre en cause sa qualité d’artiste. Que va décider la juge ? Le suspense est à son comble… Réponse vendredi 25 novembre !
Quoiqu’il en soit, non, vous ne rêvez pas, aujourd’hui en France, un artiste peut être poursuivi pour avoir librement intégré les couleurs nationales au sein d’une création ! Si Yo du Milieu venait à être condamné, nous serions confrontés à une nouvelle attaque en règle contre nos libertés individuelles et collectives, à un pur et simple acte de censure politique.
Ce n’est plus un secret pour personne : ce gouvernement s’est fait une spécialité des lois liberticides. Dans cette affaire, nous allons bientôt voir si l’arbitraire l’emporte une fois de plus sur le droit, si la défiguration du droit s’impose sur le droit. Car oui, Yo du Milieu a le droit pour lui ! Le Conseil d’État – rien de moins – a indiqué que la loi sur l’outrage au drapeau n’entend « incriminer que les dégradations physiques ou symboliques du drapeau susceptibles d’entraîner des troubles graves à la tranquillité et à la sécurité publiques et commises dans la seule intention de détruire, abîmer ou avilir le drapeau ; qu’ainsi le texte n’a pas pour objet de réprimer les actes (…) qui reposeraient sur la volonté de communiquer, par cet acte, des idées politiques ou philosophiques ou feraient oeuvre de création artistique. »
« Comment contester la qualité d’artiste à Yohan Leforestier ? », demande l’avocat de la défense, Maître Olivier Lehoux, dénonçant « des poursuites essentiellement idéologiques ». Pour lui, l’infraction n’est pas constituée : par son acte, Yo n’a pas troublé gravement l’ordre public, une des conditions cumulatives avec l’intention d’outrager le drapeau tricolore.
Nous refusons la logique d’intimidation qui se cache insidieusement derrière les poursuites lancées contre Yohan Leforestier, cette même logique qui étend toujours plus son empire depuis la prise de pouvoir de Nicolas Sarkozy et la montée en puissance de ses fidèles.
La cause pour laquelle nous luttons aujourd’hui est une cause juste et nous sommes déterminés à ce que la justice française le reconnaisse. Au-delà du cas de Yohan Leforestier, c’est un combat global que nous menons au nom de la liberté et plus particulièrement de la liberté d’expression et de création !
Nous vous donnons rendez-vous le vendredi 25 novembre dès 12h devant le Tribunal de police de Caen (rue Georges Lebret, adjacente à la Place de la République). Nous vous invitons à apporter de quoi pique-niquer solidairement en attendant le rendu du jugement, prévu à 13h30. Enfin, si vous souhaitez participer à l’action symbolique que nous avons prévue, munissez-vous d’objets bruyants.
